Applicability

This Privacy Policy describes how Hertz Car Sales, LLC, and its subsidiaries and affiliates treat your information. It applies on the sites and apps where it appears. This includes the Car Sales platforms. It does not apply to other interactions you have with the Hertz companies. This includes when you interact with Hertz car rental or our Dollar or Thrifty brands. It also does not cover if you apply for a job with us or when you interact with us as an employee. This policy also does not apply if you are interacting with us to get vehicle financing or insurance. In those situations your information will be used as described by our Financial Privacy Notice or the applicable lender's GLBA Notice.



Notice at Collection

Information We Collect
We collect information about you in various ways when you use our platforms. Those are listed below:

  • Contact information. We collect your name and mailing address. We also collect your phone number and email address. We collect your zip code.

  • Vehicle and preference information. We may collect vehicle identification numbers and license plate numbers. We may also collect vehicle makes and models. We may also collect car title information. We may do this as part of servicing a vehicle. We may also collect information about the types or features of vehicle you search. We may collect other preferences you indicate through your use of our platforms.

  • Payment information. We collect payment information if you make a purchase that falls outside of our financing of a car. (Our Financial Privacy Notice covers those practices.) Information we collect may include credit or debit card numbers or bank account numbers.
  • Information you submit. We will collect information you submit to us. For example, the contents of your questions. This may include feedback and suggestions.
  • Device and platform information. We collect IP addresses and MAC addresses. We also collect information about your browsing activity. This might include where you came from before arriving on our platforms or where you go from our platforms. We may also collect times and dates of visits or pages you visit. We also collect information about your browser type, operating system, and device. We may also collect your approximate location.
  • California law requires that we tell you if we share information for cross-contextual behavioral advertising. We may share contact, vehicle, commercial, device, and platform information for cross-contextual behavioral advertising.     Business Use of Information Collected
    We use your information for the reasons set out below:

  • For our relationship with you. We use your information to maintain your account or give you access to our platforms. We also use information to fulfill orders and offer our services. This includes vehicle maintenance services.
  • To communicate with you. We use information to answer questions and respond to feedback. We may also send you notices. These might include security alerts or product and service updates.
  • To improve our products and services. We use your information to improve our platforms and services. This includes customizing and improving our services and platforms, or your experience. We may also use your information to develop new programs and services. This may include internal research and development.
  • To provide marketing. We use information to provide you with information about products or special offers. We may also tell you about new features or give you information about other vehicles or services. We may also provide you with other promotional information we think you may find of interest. This might be about us or third parties. We may provide this to you by email or text, through social media channels, or on other digital platforms as permitted by law.
  • To protect our company and constituents. We use information to protect our company and customers. We also use information to identify fraud and secure our systems. We will also use information to comply with the law. This includes responding to law enforcement or regulatory requests.
  • As otherwise permitted by law (or as we may notify you).

  • Sensitive Information Collection and Use
    We do not use, or disclose sensitive personal information, as that term is defined by California law, for inferring characteristics as permitted by law. We also do not otherwise use or disclose sensitive personal information for purposes other than those permitted by law.

    How We Collect Information

    We collect information directly from you. We collect personal information when you contact us. This might be about a vehicle or to create an account. It might also be when you sign up for offers or alerts.

    We collect information passively. We collect information through tracking tools over time and across different websites and apps. These may be our own platforms or elsewhere.     We collect information about you from others. We may get information about you from others. This includes business partners or vendors. This includes marketing partners or email vendors.     We Combine Information

    We combine information that we have collected from different sources. We also combine information collected across devices. This might include information collected from computers with that collected on mobile devices. We also combine information that we get from others with information we already have.



    When We Disclose Information

    Below are times when we disclose personal information and the categories of recipients:

    • To our affiliates. We may disclose all categories of information to our affiliates and related entities.

    • For cross-contextual behavioral advertising. In the Notice at Collection (above), we outline which categories of information we share for cross-contextual behavioral advertising.

    • To vendors and service providers who perform services on our behalf. We may disclose all categories of information with trusted service providers. This includes parties that help us provide products and services like warranty and roadside assistance. It also includes marketing and software support vendors.     • If we think we have to in order to comply with the law or protect ourselves. We will transfer all categories of information to respond to a court order or subpoena. We will also disclose these categories of information if a government agency or investigatory body requests it. We may also disclose these categories of information to investigate potential fraud or to enforce our policies and terms. We will make these disclosures where we have a good faith belief that we are required to do so.

    • With successors to all or part of our business. If all or part of our business is sold, we may transfer all categories of information as part of that transaction. If there is a merger or acquisition, we will do this as well.

    • For other reasons we may describe to you and as otherwise permitted by law.

    Additional information for residents of certain jurisdictions. California law requires that we tell you if we sell personal information with a third party for monetary or other valuable consideration. We may sell or otherwise monetize your information to unrelated third parties as permitted by law. We do not sell personal information of minors under the age of 16 for monetary or other valuable consideration.



    Your Rights and Choices

    You Can Opt Out of Marketing Emails
    You may opt out of receiving marketing emails you receive from us. To do so, follow the instructions in the message you receive. You may still receive our transactional and relevant operational communications.

    Cookies and Tracking Tools
    We collect personal information about users over time and across different websites. We also serve content on our platform or third-party platforms based on your behaviors and interests. To do this, we use common tracking tools. These may include browser cookies or web beacons. We may also use flash cookies and similar technologies. We might look at these activities on our platforms or others' platforms. We work with third parties who help gather this information. That information might be collected on or offline.

    • Why and how we use tracking tools. We use to engage in interest-based or cross-contextual behavioral advertising. This includes serving advertising content to you based on information gathered from you over time across multiple sites or other platforms. It includes serving ads to you after you leave our website, or ads we think are relevant based on your online activities. These ads might be served on our platforms or elsewhere. We may also use tracking tools to recognize and understand new or past visitors or improve our platforms. We may also use them to integrate with third-party sites.

    • You can control cookies and tracking tools. Your browser may allow you to control cookies or other tracking tools. How you do so depends on the type of tool. Certain browsers can be set to reject browser cookies. If you block cookies, certain features on our platforms may not work. If you block or reject cookies, not all the tracking described here will stop.

    • Our "Do Not Track Policy". Some browsers have "do not track" features that allow you to tell a website not to track you. These features are not all uniform.

    • Notice of Right to Opt-Out of Sharing. You can also configure certain browsers to tell websites not to share your information for these reasons through the "global privacy control" signal.     Specific Rights in Certain Jurisdictions
    You may have additional rights if you are a consumer who lives in California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, Virginia, or a jurisdiction with similar laws. Those rights depend on our relationship. These rights include:

    Nevada residents. You can email us at privacy@Hertz.com to opt out of the future sale of your information to a third party so that they may license or sell that information.

    These rights are not absolute. In some situations, we may not be able to process your request. This may include if a legal exception applies. We will not discriminate against you if you exercise your rights.

    Third-Party Agents
    If you are submitting a request on someone else's behalf, we may ask for additional verification. This may include a signed letter verifying your right to make this request.



    Security and Storage

    We use reasonable security measures as required by law. The Internet is not 100% secure. We cannot promise that your use of our platforms will be completely safe. We encourage you to use caution when using the Internet. This includes not sharing your passwords.

    We store your information in the United States. If you live outside of the United States and choose to use our platforms, you understand that it is at your own risk. You also understand that information is sent to the United States. The United States may not afford the same level of protection as laws in your own country.



    Third Party Links and Platforms

    Our platforms may contain links to other sites that we do not operate. If you click on a third-party link, you will be directed to that third party's site. We recommend that you review every site's privacy policy. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.



    Our Platforms and Children

    Our platforms are meant for adults. We do not knowingly collect personally identifiable information from children under 13.
